The Prosecuting Attorney’s office assists merchants with prosecution and collection of restitution due to hot checks. Typically the following checks usually cannot be prosecuted as “hot” checks:
- Post-dated checks
- Stop-payment checks
- Two-party checks
- Checks which are more than a year old
- Checks for which partial payment has been received
- Checks given in exchange for a returned check
- Checks which do not identify who accepted it
- Checks received in the mail
- Checks not presented to the bank within 30 days of issuance
